CONSERVATION LAND PLANNING: for Landowners
There are many ways to help protect the rural character of
Lincoln. If you own land in Lincoln that you would like to
protect, there are several mechanisms that we can explore.
The tool that we use most frequently is a Conservation
Restriction. A Conservation Restriction is a legal agreement
that limits development on a parcel to conservation oriented
uses, such a limited agricultural uses, passive outdoor
recreation, and conservation. Effectively, the land owner
gives up development rights on the parcel. Such a restriction
is only available for land of Conservation Interest where the
conservation is in the public interest.
In general, there are three ways you can protect your land:
Protect land and continue to own it. In this case, you might
have land that is of conservation interest. This land might be
a portion of a residential parcel, or might abut your residence.
If you wish to continue to own the parcel, but want to ensure
that the open space you enjoy is preserved for all time, RLF
can work with you to place a CR on your property. Since giving
up the development rights may decrease the value of your
property, a CR may reduce your property taxes.
Donate or sell land for conservation purposes. You might have
land of conservation interest that you are not interested in
owning. Perhaps you would like to make a charitable donation
(by selling the property to a conservation organization for a
below market price, or by donating it). RLF is a 501(c)(3)
organization and can help you through the process of donation
(or bargain sale).
Sell land to a conservation minded buyer. Perhaps you are
interested in selling the land to a conservation minded buyer
who will develop your land consistent with the protection of the
conservation values of the property. In this case, RLF can
work with you to develop a conservation plan for your
property.
